Family-owned Mid Continent Trucking of Denison, Iowa, notified drivers and employees recently that after 24 years, the refrigerated carrier was ceasing operations two days after Thanksgiving because of worsening economic conditions and tumbling freight rates. In the email to the company’s 25 employees, the Wickershams stated: “You may have heard some rumors about some changes going on at Mid Continent. If not, there is something going on and this notice is to let you know that Brian and Ted have sold our equipment to Western Flyer Express.” Western Flyer Express, doing business as Western Flyer Xpress (WFX) and RWTL Capacity Solutions have a common owner. Both companies are headquartered in Oklahoma City. The Biden administration has unveiled a proposed rule that could raise costs for trucking companies and gig transportation, such as Uber and Lyft, that rely on independent contractors. The 184-page proposed rule, revealed by the U.S. Department of Labor’s Wage and Hour Division (WHD) on Tuesday, reinstates guidance similar to that used under the Obama administration that is considered less favorable to classifying workers as independent contractors. The DOL’s new proposal would modify WHD regulations to revise its analysis for determining employee or independent contractor classification under the Fair Labor Standards Act (FLSA) “to be more consistent with judicial precedent and the act’s text and purpose.” . . . As incoming Nikola Corp. CEO Michael Lohscheller took the podium at the IAA Transportation 2022 conference pitching his company's zero-emission trucks, Nikola founder Trevor Milton was 4,000 miles away in a New York courthouse facing charges he duped company investors. To be sure, Nikola has separated itself from Milton. Late last year, it reached a $125 million settlement to resolve a fraud investigation by the Securities and Exchange Commission. The company did not admit wrongdoing. And Nikola needs to staunch its losses as it begins to sell trucks and collect revenue. It lost $173 million on sales of $18.1 million in the second quarter. But Lohscheller also has to create a turnaround in the perception of the company. Nikola produced 50 battery-electric Class 8 tractors in the second quarter and delivered 48. It's on track to produce 65 to 70 in the third quarter. Prototypes of the hydrogen fuel cell truck — the concept that launched the business — are in testing with Walmart and Anheuser-Busch. The fuel cell trucks are scheduled to go into production in the latter half of 2023 in the U.S. and in Europe the following year. One area where Nikola is working to gain an early advantage is through an aggressive fueling infrastructure approach. Executives from Daimler and Volvo talked at IAA Transportation about how a lack of green hydrogen availability and fueling stations could limit sales of fuel cell trucks even as regional and national governments start to ban diesel vehicles. Following multiple delays since its original announcement back in 2017, Tesla (NASDAQGS:TSLA +0.47%) ‘s Semi Truck is finally about to be released. According to the automaker’s CEO Elon Musk, the company is now looking to produce and begin delivering the Semi Trucks before the end of the year, equipping the fleet with a 500-mile range. On top of that, Musk also claims that the long-awaited Cybertruck will finally be available to customers in 2023, although he hasn’t indicated any specific window of release within the year. It’s unclear which business will be receiving the Semi Truck before the close of 2022, but Electrek highlights that PepsiCo could be one of the first to put the truck in use. Back in 2017, the conglomerate put in one of the biggest orders for the Semi, purchasing 100 of them for its shipping and logistics operations. It also intends to set 15 aside to be used within its Frito-Lay Modesto site in order to turn it into a zero-emission facility. . . . Truckers protesting a state labor law effectively shut down cargo operations at the Port of Oakland, it was announced Wednesday. The truckers are protesting Assembly Bill 5, a gig economy law passed in 2019 that made it harder for companies to classify workers as independent contractors instead of employees, who are entitled to minimum wage and benefits such as workers compensation, overtime and sick pay. A federal appeals court ruled last year that law applies to some 70,000 truck drivers who can be classified as employees of companies that hire them instead of independent contractors. “We understand the frustration expressed by the protestors at California ports,” Port of Oakland Executive Director Danny Wan said in the port statement. “But, prolonged stoppage of port operations in California for any reason will damage all the businesses operating at the ports and cause California ports to further suffer market share losses to competing ports.” . . . The idea of Pelican Logistics, LLC. was birthed in 2018 by four owners/managing members. All of us were working our respective careers, but we knew we wanted something more. All four of us have known each other since childhood, so we have always had a relationship where we would bounce ideas off of one another. Business/ownership was on our minds. We heard that trucking was a good industry to get into. None of us had any experience in the trucking industry, but one thing led to another and we found ourselves at the bank with a business plan a few months later (getting denied for loans over and over). Pelican Logistics LLC, serves everyone via the distribution of goods through trucking. Our business structure is very fluid in comparison to others in our sector. It is ready and willing to adapt to the needs of the industry and the inevitable change. We also invest our profits into assets, making our business more sustainable. Starting a business only requires basic information that is readily available via the internet. To properly structure a business only requires that you employ someone familiar with business/taxes (I personally recommend an accountant or CPA familiar with your industry). The most difficult part is start-up capital. The best way to do with is with OPM (other people’s money). To inspire others to loan you their money, you must make your idea look as appealing as possible to them. Depending on your audience, you will have to market yourself differently. OAKLAND -- Supply-chain problems continue to impact the shipping industry just as new emissions rules will eliminate tens of thousands of trucks from California roads. From product shortages to rising prices, the supply chain problems are having a profound effect on the state's economy. But the situation is about to get a lot worse, as new emissions rules come into effect. Back in 2008, Governor Arnold Schwarzenegger signed into law a new set of regulations for trucks and buses to reduce pollution. The final rule will go into effect this January 1st, banning diesel trucks with engines made before 2010. "They're going to knock out of the Port of Oakland with this rule. About 1,800 owner-operators who simply don't have the wherewithal, because of these economic conditions, to replace these trucks," said Joe Rajkovacz with the Western States Trucking Association. The ban applies to all trucks moving through the state, so there are dire predictions about what will happen to the supply chain as imported manufactured goods arrive at California ports for distribution across the country. The new emissions rule also includes buses. But, unlike trucks, the state has a grant program to help pay public transit agencies and school districts for the vehicle upgrades. . . . This year, the CVSA’s “Operation Safe Driver Week” is scheduled for July 10 — 16, and it will take place throughout the U.S., Canada, and Mexico. During the week-long operation, law enforcement agencies will be monitoring both passenger and commercial vehicle drivers for unsafe behaviors, including distracted driving, following too closely, improper lane change, and drunk or drugged driving. The area of focus for Operation Safe Driver Week 2022 is speeding. Speeding was also the focus of last year’s Operation Safe Driver Week effort. During last year’s Operation Safe Driver Week, 28,148 commercial motor vehicles and 17,910 passenger vehicles were pulled over between July 11 — 17, 2021. Those drivers were issued a total of 10,486 warnings and 16,863 citations. Also ahead is CVSA Brake Safety Week, which is scheduled for August 21 — 27, 2022. During this campaign, commercial motor vehicle inspectors conduct brake system inspections on large trucks and buses throughout North America to identify brake-system violations. . . . Louisiana lawmakers signed into law a bill meant to cut down on speeding on the Atchafalaya Basin Bridge in order to reduce the number of crashes. On June 15, Louisiana Governor John Bel Edwards signed into law Senate Bill 435 to establish the Atchafalaya Basin Bridge carrying I-10 as a “highway safety corridor.” As a “highway safety corridor,” the standard fine for speeding of $175 would double to $350 following a one-time warning. Subsequent speeding violations would result in $1000 fines. The new law will also require transportation officials to install “camera safety devices” on the Atchafalaya Basin Bridge to enforce the speed limit on the bridge. The bill will also require more signage regarding the bridge speed limit, as well as six sets of “Trucks Right Lane Only” signs equally spaced on the eastbound portion of the bridge and six sets of “Trucks Right Lane Only” signs equally spaced on the westbound portion of the bridge.” The law goes into effect August 1, 2022. . . . As he prepared to fill his rig with nearly 160 gallons of fuel at Carter Express' corporate headquarters, Marcus Speikes was thankful for one thing. "I'm happy it's the company (paying for fuel) and that it's not out of my pocket," Speikes said with a chuckle. "I couldn't afford to have my own truck and pay $900 or $1,000 every time I have to fill up." Speikes estimates that's what it costs to cover the roughly 2,800-mile round trip from Anderson to Laredo, Texas, that he hauls freight on each week. A few months ago — roughly about the time Russia invaded Ukraine — Speikes said the trip required about $500 in fuel. As record high gas prices have jolted American motorists and sent shock waves through the economy, the trucking industry has felt pain at the pump more sharply than many other sectors. Local trucking and logistics companies have been feeling the pinch for several weeks. Carter Express is spending more than $750,000 a week on fuel for its fleet of about 800 trucks, according to president and CEO Jessica Warnke. That's up from about $550,000 a week in January, she said. "If you're trying to run your own business, you're really struggling," Langston said. "There are a lot of those folks who either have reached that point or are getting close to that point where they say, 'I can't do this anymore.' It's really unfortunate." When a continued shortage of drivers is added to the equation, the consequences will likely be far-reaching and long-lasting. "I don't think there's a number on the pump that gets us there," she said. "I think there is a price that at some point the industry can no longer bear, and customers will have to make tough decisions, and that will directly affect us and our drivers and our employees." . . .
