Forced arbitration re-victimizes sexual assault survivors by denying a public trial and coercing them into silence. Meanwhile, abusers are emboldened to operate with impunity. Ending forced arbitration of sexual assault claims will allow survivors to speak openly and will protect others in workplaces across the country. Yesterday, we heard from four women at the House Committee of the Judiciary (@housejuddems) hearing. Eliza Dushku (@ElizaDushku), Tatiana Spottiswoode, Andowah Newton, and Lora Henry shared their stories of the fear and harm inflicted upon them by their employers. Forced arbitration clauses restrict Americans’ access to justice by stripping workers of their right to go to court. These clauses, which are often buried in the fine print of employment contracts, shuttle victims of workplace sexual violence, harassment, and discrimination into private arbitrations, where the arbitrator, the law, and the rules applied are often chosen by the company. These proceedings are conducted in secret, without public rulings and with no judicial review. FACT: At least 1 in 4 women experience sexual harassment in the workplace. Forced arbitration silences those who speak out and allows for toxic office cultures to flourish. Survivors of sexual harassment and sexual assault should not have to suffer in silence.
